Welcome to LearnFittings.com. These Terms of Service form a binding agreement between you and Hose Box Inc., a corporation registered in the State of Montana, United States ("Hose Box," "we," "us," or "our"), and govern your access to and use of our website and its educational content.

By accessing or using LearnFittings.com (the "Site"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Site. Please read these Terms carefully, together with our Privacy Policy, Disclaimer, and Accessibility statement, each of which is incorporated into these Terms by reference. Please pay particular attention to the sections titled "Disclaimer of Warranties," "Limitation of Liability," "Indemnification," "Governing Law and Venue," "Dispute Resolution," and "Limitation Period," which limit our liability and affect your legal rights.

About This Site

The Site is a free, bilingual (English and Spanish) educational resource published by Hose Box Inc. It is designed to help users learn how to identify hydraulic fittings and D.O.T. air fittings, including thread types, sealing methods, torque specifications, hose and dash sizing, and related formulas, using our color-coded Fitting Tiles(R) system. The Site is provided for general informational and educational purposes only.

The Site has no user accounts, no login, no e-commerce functionality, and no checkout. You cannot purchase anything on the Site, and we do not collect payment information through it. Physical products are sold separately at hosebox.com under that website's own separate terms and conditions. Nothing in these Terms governs the purchase, sale, shipment, return, or warranty of any physical product, all of which are addressed exclusively by the terms applicable at hosebox.com. We may, in the future, add features such as a newsletter sign-up or website analytics; if and when we do, your use of those features will also be subject to these Terms and to our Privacy Policy.

Eligibility

You must be at least 18 years old to use the Site on your own behalf, or you must use the Site under the supervision of a parent, guardian, or other responsible adult. By using the Site, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at support@hosebox.com.

If you use the Site on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" refer to that entity. If you do not have such authority, you may not use the Site on the entity's behalf.

Educational Use Only; No Professional Advice

All content on the Site is provided as GENERAL EDUCATIONAL INFORMATION ONLY. It is not, and must not be relied upon as, engineering, technical, professional, installation, or safety advice for any specific application. Hydraulic and air-fitting systems can operate at high pressure and can cause serious injury, death, or property and equipment damage if components are misidentified, mismatched, improperly assembled, or improperly torqued.

Other names, logos, and marks appearing on the Site may be the trademarks of their respective owners and are used for identification purposes only, without any claim of ownership or endorsement.

Subject to your compliance with these Terms, Hose Box Inc. grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and view the Site and its content for your own personal or internal business reference. This license does not transfer any ownership or other right to you, and we reserve all rights not expressly granted. Except as expressly permitted by this license, you may not copy, reproduce, republish, download (other than ordinary page caching by your browser), distribute, sell, license, publicly display, transmit, frame, mirror, scrape, harvest, or create derivative works from any part of the Site, and you may not remove, obscure, or alter any copyright, trademark, or other proprietary notice. We reserve the right, but assume no obligation, to investigate any suspected violation of these Terms and to take appropriate action, including restricting or terminating your access to the Site, removing content, and cooperating with law enforcement, in each case without notice and without liability to you.

Disclaimer of Warranties

THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, AND FEATURES MADE AVAILABLE ON OR THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSE BOX INC. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HOSE BOX INC. OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY OR EQUIPMENT DAMAGE, ARISING OUT OF OR RELATED TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE, OR YOUR RELIANCE ON ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT HOSE BOX INC. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF HOSE BOX INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). YOU ACKNOWLEDGE THAT THE SITE IS PROVIDED FREE OF CHARGE AND THAT THIS LIMITATION REFLECTS A REASONABLE ALLOCATION OF RISK AND IS AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND HOSE BOX INC. THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow the exclusion or limitation of incidental, consequential, or certain other damages, or the exclusion or limitation of liability for personal injury, death, gross negligence, fraud, or willful misconduct, so some of the above limitations and exclusions may not apply to you. In such cases, the liability of Hose Box Inc. is limited to the smallest amount permitted by applicable law. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Hose Box Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Site, your reliance on any content, your violation of these Terms, your violation of any applicable law, or your infringement of any right of any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses. You may not settle any matter that imposes any obligation or liability on Hose Box Inc. without our prior written consent. This indemnification obligation survives the termination of these Terms and your use of the Site.

Changes to the Site and Terms

We may modify, suspend, or discontinue the Site, or any part of it, at any time and without notice or liability. We may also revise these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page, and the revised Terms will govern your use of the Site from the date they are posted. Your continued use of the Site after any change to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

Governing Law and Venue

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Montana, without regard to its conflict-of-laws rules. You agree that the exclusive jurisdiction and venue for any action or proceeding arising out of or relating to these Terms or the Site will be the state and federal courts located in Cascade County, Montana, and you irrevocably consent to the personal jurisdiction of those courts and waive any objection to the laying of venue in those courts, including any objection based on forum non conveniens.

Dispute Resolution

Before filing any claim against Hose Box Inc., you agree to first attempt to resolve the dispute informally and in good faith. To begin, you must send a written description of your claim, including your name, contact information, and the specific relief you seek, to us by email at support@hosebox.com. You and Hose Box Inc. agree to make a good-faith effort to resolve the dispute through this informal process for a period of at least thirty (30) days after the notice is received before either party may commence a court action. This informal-resolution requirement is a condition precedent to filing suit, except that either party may seek injunctive or other equitable relief at any time to protect its intellectual property or confidential information.

All disputes will be resolved exclusively in the courts identified in the "Governing Law and Venue" section above. There is no arbitration requirement and no class-action waiver applicable to your use of this Site. Except as a court may otherwise order or as otherwise required by applicable law, each party will bear its own costs and attorneys' fees in connection with any dispute.

Limitation Period

TO THE EXTENT PERMITTED BY LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ARISES; OTHERWISE, IT IS PERMANENTLY BARRED. Some jurisdictions do not allow a contractual shortening of the applicable limitations period, so this provision may not apply to you to the extent prohibited by law.

General

These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and Hose Box Inc. regarding the Site and supersede any prior or contemporaneous agreements or understandings on that subject. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision, and no waiver is effective unless made in writing.

We may assign or transfer these Terms, in whole or in part, at any time without notice to you; you may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent, and any attempted assignment in violation of this provision is void. These Terms do not create any third-party beneficiary rights, except that the officers, directors, employees, agents, and affiliates of Hose Box Inc. are intended beneficiaries of the "Disclaimer of Warranties," "Limitation of Liability," and "Indemnification" sections. You consent to receive communications from us electronically, and you agree that electronic communications and records satisfy any legal requirement that such communications be in writing. The sections of these Terms that by their nature should survive termination will survive, including the intellectual-property, disclaimer, limitation-of-liability, indemnification, governing-law, dispute-resolution, and limitation-period provisions. These Terms may be made available in more than one language; in the event of any conflict or inconsistency between versions, the English-language version of these Terms controls.
